How nice of the Commonwealth to fund and furnish highly trained professionals to create a political advert for the current AG's future political campaigns.
There is a good faith legal argument to be made against the mandate element of the Health Care legislation. But all the blowsy ideological economic theory in the brief should be of little real interest to the court, have very little or (more likely) no impact on the outcome of the litigation, and must be there only to tickle the erogenous zones of certain types who might vote in (or, more significantly, contribute to) subsequent campaigns. At least it's at a higher conceptual level than the usual political nonsense that gets thrown around. But it is an imposition on the functions and intelligence of the Court of Appeals. I'll wager a genuine American dollar paid to the DNC (something that would pain me deeply) that the Circuit either completely ignores that part of the brief or expressly dismisses it.

After all, if there's one thing appellate courts NEVER engage in, it's blowsy ideological theories (or paeans to baseball, or opinions in the form of poetry).
